Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the website at tech911.co (the “Site”) and the technology support, IT, software, and related services provided by Tech911 LLC (“Tech911”, “we”, “us”, or “our”). By accessing the Site, requesting a quote, purchasing a plan, or using any of our services (together, the “Services”), you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services.

1. Who we are

Tech911 LLC is a Florida limited liability company based in Boca Raton, Florida. We provide remote and onsite technology support and related IT, software, and web services to businesses and individuals. You can reach us at info@tech911.co or 305-832-4911 (305-TECH911).

2. Eligibility and authority

You must be at least 18 years old to use the Services. If you accept these Terms on behalf of a company or other organization, you represent that you have the authority to bind that organization, and “you” refers to both you and the organization.

3. The Services

Tech911 provides remote and onsite support for desktops and laptops, mobile devices, printers, networks and VPNs, and Microsoft 365 and other applications. We also provide related IT services such as data backup, firewall and network configuration, email migration, and employee onboarding and offboarding, as well as custom software, mobile application, integration, and website development and maintenance. The specific scope, deliverables, response targets, and limitations of any engagement are those described at the time of purchase or in a separate plan description, quote, or statement of work. We may add to, modify, or discontinue any part of the Services at any time.

4. Service plans, one-time services, and quotes

We offer both (a) recurring subscription support plans and (b) one-time or hourly per-incident services. The features and price of each plan or service are described at the point of sale. Estimates and quotes are valid only for the period stated and are not a guarantee of final cost where the actual scope of work changes. If a task requires materially more work than estimated, we will let you know before continuing where reasonably practical.

5. Remote access and onsite service consent

Many Services require remote access to your devices, systems, or accounts, or onsite attendance at your location. By requesting such Services, you authorize Tech911 and its technicians to access, view, install, configure, modify, and remove software and settings on the relevant devices and accounts as reasonably necessary to perform the Services. You confirm that you own, or are authorized to grant access to, those devices, systems, accounts, and data. You are responsible for ending any remote session and revoking access when you no longer want it active. Support sessions may be recorded for quality, training, and security purposes, as described in our Privacy Policy.

As part of the monthly unlimited support plan, Tech911 requires a small remote support agent to be installed on each covered computer. This agent lets Tech911 technical support agents securely connect to the device to diagnose and resolve the issues you have contacted Tech911 about. A technician connects only with your permission at the time of each session, and the agent is used solely to deliver the support you have requested. You may ask Tech911 to remove the agent at any time, and it is removed when your plan ends.

6. Your responsibilities

To help us deliver the Services safely and effectively, you agree to:

  • back up your data before any Service begins, as Tech911 is not a backup service unless you have expressly purchased one;
  • provide accurate information and the access, credentials, and cooperation we need;
  • hold valid licenses for any third-party software you ask us to install or configure;
  • keep your own accounts, devices, and passwords secure;
  • use the Services only for lawful purposes; and
  • authorize and supervise the scope of work being performed.

Delays, failed work, or additional charges may result from inaccurate information, missing access, or unlicensed software.

As part of delivering and securing the Services, Tech911 will typically ask the people who use a computer day to day to work from a standard user account, created locally or through Active Directory, rather than from an administrator account they use for everyday tasks. Reserving administrator rights for the occasions when they are genuinely needed is a widely recommended security practice: it strengthens security and reduces the likelihood of malware and of unwanted or accidental installation of programs. Tech911 will help set up and configure these accounts as part of the engagement.

7. Fees, billing, and taxes

Subscription plans are billed in advance on a recurring basis (monthly or as otherwise stated) and automatically renew for successive periods until cancelled. Per-incident and hourly Services are billed as described at purchase or on completion. You authorize Tech911 and its payment processor to charge your payment method for all applicable fees, including renewals, until you cancel. Fees are exclusive of taxes, and you are responsible for any applicable sales or other taxes. We may change prices; for subscriptions, a price change applies at the next renewal after we provide notice.

8. Late payments

Past-due amounts may lead to suspension of the Services and may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law, together with reasonable costs of collection.

9. Cancellation and refunds

You may cancel a subscription plan at any time, effective at the end of the current billing period. Cancellation stops future renewals but does not refund amounts already paid for the current period, except where required by law. One-time and hourly Services are generally non-refundable once work has begun. If we are unable to begin a Service you have prepaid, we will offer a credit or a refund of the unused, prepaid amount. Where specific plan terms differ from this section, those plan terms control.

10. Third-party products, software, and services

We may recommend, resell, install, or configure third-party products and services, for example Microsoft 365, security software, backup tools, or hardware. Those products are governed by the third party’s own license terms, warranties, and privacy practices, which you agree to follow. Tech911 is not the manufacturer or licensor of third-party products and provides no warranty for them beyond any warranty the third party passes through. Hardware is covered only by the manufacturer’s warranty.

11. Acceptable use

You will not use the Site or Services to violate any law, infringe intellectual property or privacy rights, transmit malware, gain unauthorized access to any system or data, or ask us to do any of these things on your behalf. We may refuse, suspend, or terminate any Service we reasonably believe involves unlawful or harmful activity.

12. Intellectual property

The Site and its content, and any tools, scripts, documentation, and materials that Tech911 develops and provides (other than your data and your pre-existing materials), are owned by Tech911 or its licensors. Unless a separate agreement says otherwise, custom deliverables we create specifically for you and that you have paid for in full are licensed or assigned to you as set out in the applicable statement of work. You retain ownership of your own data and content.

13. Confidentiality

In the course of an engagement, each party may receive confidential information of the other. Each party agrees to use the other’s confidential information only to provide or receive the Services and to protect it with reasonable care. This obligation does not apply to information that is or becomes public through no fault of the receiving party, was already known to it, is independently developed, or is required to be disclosed by law.

14. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

15. Warranties and disclaimers

We will perform the Services with reasonable skill and care. Except as expressly stated in these Terms, the Site and Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any specific issue will be resolved, that the Services will be uninterrupted or error-free, or that data will not be lost or corrupted. You remain responsible for maintaining current backups of your data.

16. Limitation of liability

To the fullest extent permitted by law, Tech911 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or business, arising out of or relating to the Site or the Services, even if we have been advised of the possibility. Tech911’s total liability for all claims relating to the Services will not exceed the greater of the amount you paid Tech911 for the specific Service giving rise to the claim in the three months before the event, or one hundred U.S. dollars. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Tech911 and its members, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or Services, your violation of these Terms or of any law, or your infringement of any third-party right.

18. Service availability and changes to these Terms

We may modify, suspend, or discontinue all or part of the Site or Services at any time. We may also update these Terms from time to time. The “last updated” date above reflects the most recent version, and material changes take effect when posted or as otherwise stated. Your continued use of the Site or Services after a change means you accept the updated Terms.

19. Termination

You may stop using the Services at any time, subject to the cancellation terms above. We may suspend or terminate your access for violation of these Terms, non-payment, or as needed to comply with law or to protect the Services or other users. Provisions that by their nature should survive termination, including sections on fees owed, intellectual property, confidentiality, disclaimers, limitation of liability, indemnification, and governing law, will survive.

20. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute arising out of or relating to these Terms, the Site, or the Services will be the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.

21. General

These Terms, together with any plan descriptions, statements of work, or policies referenced here, are the entire agreement between you and Tech911 regarding the Services and supersede any prior agreements on that subject. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent, while we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is responsible for delays or failures caused by events beyond its reasonable control. Notices to Tech911 may be sent to the contact details below.
